This is also happening on my version 3.51 demo copy. I'm not sure why there is a requirement that the add to cart button is shown in order to show the cross selling products. The only reason I can think of is that sometimes cross selling is setup as an accessory (where you have a check box next to the accessory and clicking the add to cart button adds both products to the cart). It doesn't sound like your store is setup that way.

Barring that one exclusion I don't see why the code couldn't be modified to allow for what you want.

Currently using 3.51a

When an item/product is set "not for sale" or "out of stock" the cross selling items disappear.

Is there a way to fix this?

I want to lead customers to view other relative items in these situations.
